The Bundestag – Germany’s federal parliament – passed a new bill on Friday, April 12, allowing citizens to change their sex on legal documents once a year regardless of whether they are undergoing hormone therapies or have had gender surgeries.
The new law eliminates the mandate for an expert’s assessment when changing sex on legal documents. Now, an oral request is all that is needed. This new law takes effect in November. (Related: World’s first transgender clinic was formed in Germany in 1919 by gay Jewish doctor.)
The legislation on gender “self-determination” was supported by 374 parliamentarians, opposed by 251 and the remaining 11 abstained.
The new legislation repeals previous regulations that go back to 1981, which state that an individual wishing to change their legal sex must go through two psychological evaluations, and the final call on the change will be based on the decision of a district court.
Chancellor Olaf Scholz’s governing coalition contended that the current proceedings were debasing toward transgender individuals, as they had to share personal information with officials.
“We show respect to trans, intersex and non-binary people – without taking anything away from others. This is how we continue to drive the modernization of our country. This includes recognizing realities of life and making them possible by law,” Scholz said.
Under the new law, parents can request to change the gender of a child as young as five, with the approval of the child. Children over 14 will be able to change their first name and gender only, provided that they have the permission of their parents or legal representatives. Those under 14 years old will require their parents or legal guardians to make the announcement.
In the past, changing your registered gender needed a doctor’s certificate and the approval of a family court. Today, people over 18 years of age can change to male, female or “diverse,” a third gender option that already exists under German law. A person will be permitted to make a change once every year.
Applicants will then have to appear at a registry office in person three months later after they request a change. They can also request that no information concerning their gender be registered at all, except when it is a legal requirement because of court proceedings or police investigations.
First names will have to represent the latest legal gender – so a male entry demands a recognized male first name while a female entry needs a recognized female first name. No additional alteration or renewal can be made within 12 months of an application being granted.
German citizens will also have the right to replace the words “father” and “mother” in the family register with the gender-neutral term “parent.” Non-binary persons can register their legal gender as “diverse.”
Under the newly passed law, anyone who tries to expose a person’s previous gender identity without the person’s consent can be fined up to 10,000 euros ($10,643). The law will also authorize saunas, swimming pools, gyms and other sports facilities to decide whether to permit biological males into women’s changing rooms and toilets.
When it comes to competitive sports, individual organizations may decide if biological males identifying as women can compete against females.
